  1. Introduction

These Terms and Conditions (“Terms”) apply to all goods and services supplied by [The Smoke Alarm Guys] (“we”, “us”, “our”) to the customer (“you”, “your”) within Queensland, Australia.

By accepting a quote, booking our services, or permitting us to carry out work, you agree to be bound by these Terms and Conditions.

  1. Compliance With Queensland Legislation

All smoke alarm supply and installation services are carried out in accordance with:

  • The Fire and Emergency Services Act 1990 (QLD)
  • The Building Fire Safety Regulation 2008 (QLD)
  • The Electrical Safety Act 2002 (QLD)
  • Relevant Australian Standards including AS 3786 and AS 3000
  • Any applicable requirements of the Queensland Fire and Emergency Services

It is the property owner’s responsibility to ensure their property complies with current Queensland smoke alarm legislation.

  1. Quotes and Pricing

  • All quotes are valid for 30 days unless otherwise stated.
  • Quotes are based on accessible resources such as online floor plans, property information and layout provided to us.
  • Additional charges may apply where:
    • Access is restricted
    • Existing wiring is non-compliant or unsafe
    • Additional work that is required to meet legislative standards
    • Additional smoke alarms that is required to meet legislative standards based on unique characteristics of the dwelling
  • Prices include GST unless otherwise stated.
  1. Bookings and Access

You must:

  • Provide safe and clear access to the property
  • Ensure power is available where required
  • Advise us of any known electrical faults or hazards
  • Ensure pets are secured

If access is not available at the scheduled time, a call-out fee may apply.

  1. Payment Terms

  • Payment is due on completion unless otherwise agreed in writing.
  • We accept payment via Stripe, bank transfer or cash on site.
  • Late payments may incur interest at the rate permitted under Queensland law.
  • Debt recovery costs may be added to outstanding balances.

Ownership of goods supplied remains with us until full payment is received.

  1. Cancellations and Rescheduling

  • Cancellations with less than 24 hours’ notice may incur a cancellation fee.
  • We reserve the right to reschedule due to weather, safety concerns, or unforeseen circumstances.
  1. Smoke Alarm Compliance

Where we provide a “Compliance Certificate” or similar documentation:

  • It reflects the condition of the property at the time of inspection only.
  • Ongoing compliance remains the responsibility of the property owner.
  • Any modifications, renovations, or damage after installation may affect compliance.

We are not responsible for changes in legislation after the date of service.

  1. Warranties

Manufacturer Warranty

Smoke alarms and components are covered by the manufacturer’s warranty (typically 5–10 years depending on product).

Workmanship Warranty

We warrant our installation workmanship for 12 months from the date of installation.

This warranty does not cover:

  • Tampering or misuse
  • Battery removal or replacement by others
  • Damage caused by water, pests, or power surges
  • Failure to maintain alarms in accordance with manufacturer instructions

Nothing in these Terms excludes rights under the Australian Consumer Law.

  1. Limitation of Liability

To the extent permitted by law:

  • We are not liable for indirect or consequential loss.
  • Our liability is limited to:
    • Re-supplying the services, or
    • The cost of re-supplying the services.

We are not liable for:

  • Pre-existing electrical faults
  • False alarms caused by environmental factors
  • Failure of alarms due to power outages, interference, or external damage
  1. Safety and Electrical Work

Where electrical work is required:

  • Work will be carried out by a licensed electrician where required by law.
  • A Certificate of Electrical Safety will be issued where applicable.

We may refuse to perform work if unsafe conditions are present.

  1. Rental Property Services

If engaged by a property manager or landlord:

  • The property owner remains legally responsible for compliance.
  • Tenants must provide access as arranged.
  • Re-attendance due to tenant refusal or no access may incur additional fees.
  1. Privacy

We collect personal information necessary to provide our services.

We will not disclose your information except:

  • As required by law
  • To suppliers or contractors engaged to complete your service
  • With your consent

  1. Force Majeure

We are not liable for delays or failure to perform services due to events beyond our reasonable control, including but not limited to natural disasters, power outages, supply shortages, or government restrictions.

  1. Dispute Resolution

  1. Both parties agree to attempt to resolve the matter in good faith.
  2. If unresolved, the matter may be referred to mediation in Queensland.
  3. These Terms are governed by the laws of Queensland.
  1. Amendments

We reserve the right to update these Terms at any time. The latest version will be available on our website.
